N và nhóm bạn của mình rủ nhau ra sông thi bơi, lặn đã vô ý làm tấm lưới quây cá nhà bà T bị hở, do đó một số cá nhà bà T nuôi đã bơi ra ngoài. Vậy Bộ luật dân sự quy định việc bồi thường thiệt hại trong trường hợp này như thế nào?

 

Điều 616 Bộ luật dân sự năm 2005 quy định: trong trường hợp nhiều người cùng gây thiệt hại thì những người đó phải liên đới bồi thường cho người bị thiệt hại. Trách nhiệm bồi thường của từng người cùng gây thiệt hại được xác định tương ứng với mức độ lỗi của mỗi người; nếu không xác định được mức độ lỗi thì họ phải bồi thường thiệt hại theo phần bằng nhau.

Như vậy, N và nhóm bạn của mình đều có trách nhiệm bồi thường thiệt hại cho bà T tương ứng với mức độ lỗi của mỗi người. Nếu không xác định được mức độ lỗi của mỗi người thì từng người phải bồi thường thiệt hại theo phần bằng nhau.
